National Anomaly Committee meeting – Decisions & Discussions

The third meeting of the National Anomaly Committee was held on 15/02/2011. The following items were taken up for discussion. No final decision on any item could be arrived at. It was more or less an exercise to understand the points of view of both sides on these items. We shall in our next communication indicate the outcome of discussion on each item.

Item Nos. 11, 12&13, 14, 20, 28,29&30, 31,37, 38,39, 40, 41, 43, 44, 45, 46, 49, 50 and 51.

During the discussion the Staff brought to the notice of the official side that the issues pertaining to the employees of Andaman and Nicobar islands, which were taken out of the agenda on the plea that the same would be discussed separately by a Committee to be set up by the Andaman Administration have not been settled. The NGO Association of A & N Islands have brought to the notice of the staff side that the A & N Administration has not taken any steps to resolve the problems even though similar issues pertaining to the employees of Pondicherry and Delhi were settled. The Official side has promised to take up the issue with the concerned in the Home Ministry to ensure that the issues are addressed expeditiously.

The official side has in the Action Taken State has indicated their inability to concede the demand raised by the Staff Side on the following two issues.

(a) Grant of increment in the case of employees whose increment falls between Feb and June. 2006.

(b) Fixing the pay of the promotees on par with the Direct recruits.

Though these issues were not discussed, the Staff Side has said that a resolution to them are urgently needed .

The official side has requested the Staff Side to indicate the items on which further discussions are needed; further details are required; and alternative suggestions could be made within 10 days so that the next and final meeting of the Committee could be convened before 31st March, 2011. It was also decided that the sub-committee of the MACP related issued will meet once again and their report submitted to the NAC .

Feedback on the 3rd meeting of the National Anomaly Committee – AIRF

3rd meeting of the National Anomaly Committee was held yesterday, i.e. on 15th February, 2011 under the chairmanship of Secretary(P), DoPT(Government of India), wherein the following deliberations were made.

Though we know that no substantial relief has been given, but we hope for some outcome in the meetings likely to be held in future.

Two issues which are very important from our point of view – one is increment from January for those who falls between February and June was virtually rejected by the Ministry of Finance(Expenditure) but yesterday we again raised this issue, and after prolonged discussions, the Secretary, DoP&T had agreed to review the matter. An indication has also been given that if Staff Side agrees for one time exemption, then the issue can be resolved.

We also raised the issue of MACP Scheme, particularly abolition of GP Rs.2000. The Jt. Secretary(Estt.) stated that we would hold another round of discussions before finalizing the issues related to MACP Scheme.

During my opening remarks, though it was out of agenda, I raised the issue of early finalization of items of Departmental Anomaly Committee which are pending with the MoF(Exp). I stated that the Departmental Anomaly Committee of Railways had sent unanimous recommendations on various items to MoF(Exp.). More than nine months have passed and these issues are still pending with the MoF and the Railwaymen are feeling lot of frustration and therefore these need immediate redressal.

Though orders for Cadre Restructuring have been issued by the DoP&T vide O.M.No.35034/9/2010-Estt.(D) dated 10th February, 2011, we raised the issue that Matching Savings is not possible in the case of Railways. The President/AIRF and Secretary, NC/JCM(Staff Side) also emphasized on the issue and stated that in the Safety Categories, Railways cannot give Matching Savings. Therefore, for Cadre Restructuring, Matching Savings should not be insisted upon. It has been agreed by the Jt.Secretary(Pers.) that if reference comes from the Railways, that would be considered favorable.

Apart from the above issues, we also discussed agenda items which were not discussed so far in the National Anomaly Committee.

Item No.11: Grant revised allowances w.e.f. 1.1.2006 – Staff Side will give list of allowances. Thereafter, it will be discussed.

Item No.12 & 13: Transport Allowance – Staff Side will supply details. Thereafter, it will be examined.

Item No.14: Revision of existing allowances which are to be withdrawn and replaced by new schemes – If Insurance Scheme is not finalized within six months in consultation with the Staff Side, Risk Allowance and Patient Care Allowance will be doubled.

Item No.20: Daily Allowance on tour: – Orders have been issued for Geological Survey of India and Ground Water Board.

Item No.28: – Grant of GP Rs.5400 in PB-2 for Astt. Accounts/Audit Officers – Will be taken-up separately with the Jt. Secretary(Pers.) and Estt.

Item No.29 and 30: Revision of Base Index for DA and Benchmark in AICPIN Scheme for grant of DA/DR w.e.f. 1.1.2006 on CPC VI level pay/pension restructuring – Staff Side will give list which will be examined by the Jt. Secretary(Pers.)

Item No.31: Child Care Leave in respect of Central Government Women Employees as a result of Sixth Pay Commission report – It will be looked into for Defence Employees.

Item No.37: Waiver of recovery of higher DA/DR drawn during the period from 1.1.2006 to 31.8.2006 – Not Agreed.

Item No.38: Anomaly in fixing grade pay -= Deferred.

Item No.39: Anomaly due to not applying uniformly the multiplication factor of 1.86 in fixing the minimum pay in all the revised pay bands applying different – Unresolved.

Item No.40: Grant of notional increment as may be due on the first day of July following the superannuation/death in service for computation of emoluments/average emoluments for pensioner benefits – Not Anomaly.

Item No.41: Fixation of pay on promotion to a post carrying the same grade pay – Staff Side stated that the issue of Additional Allowance to the Running Staff has been raised. Where it has been emphasized that since DA has already been given on Additional Allowance, other benefits should also be given on Additional Allowance to give proper relief to the Running Staff. For other categories, e.g. ASM to SM in the same grade pay or MCM to JE in the same grade pay since their responsibility increases, therefore, in all fairness, and increment must be given while fixing pay. Official Side asked the Railways to submit the list, so that decision can be taken. Staff Side mentioned that since this issue belongs to Railways only, therefore, powers should be delegated to the Railways as has been done earlier. Official Side mentioned that since the issue has already under reference to National Anomaly Committee, Railways will be asked to submit the list. Thereafter, decision will be taken at an earliest.

Item No.43: Anomaly in the pay scale/pay band and grade pay of Library Information Assistants – Already finalized.

Item No.44 : Before the 6th Pay Commission, there were 3 HAG scales of pay – Under review.

Item No.45: Anomaly in pension of those in receipt of stagnation increments in pre-revised pay scales – Official Side agreed to consider the cases where someone had stagnated beyond one year in the pre-revised scale.

Item No. 46 and 49 – Disparity in pay scales and status of officers in stenographers cadre and Anomalies in the matter of pay scales of stenographers – Will be examined.

Item No.50: Anomalies in the pay scales of official language staff – Since the issue of Rajbhasha Staff has been sent to Ministry of Finance(Exp.) Official Side agreed to send its approval at an earliest.

Item No.51: Assigning higher grade pay of Rs.4600 to Administrative Officer Gr.III and Private Secretary in Subordinate Offices – Resolved.

    Dear sir,
    What happen to pre-revised three pay scale merged Rs 5000-8000,5500-9000 and 6500-10500 in a 6500-10500 wef 01-01-2006 and upgradtion of Grade pay of Rs.4200 to Rs.4600 for pre-revised pay scale of Rs.5500-9000 ,revised to 9300-34500 with grade pay Rs.4200.NAC meeting held on 15 Feb 2011 still keeping mum on the issue.The issue is pending for want DOPT Fin Min's order for the Admin Supdt,Stores Supdt etc in DRDO's lab/estt regarding upgradtion of grade pay of Rs.4200 to Rs 4600 wef 01.01.2006 as some of them have since been retired from the service during Aug 2006 or after that. No fruitful action has been taken by the Min so far. Because the(retirees) do not have their GOD FATHER in the Ministry or anywhere thats why NAC has not taken any decision in this regard.     Dear Sir,
    The suggestion of abolishing the GP 2000 will solve the problems of many cadres in different departments and ministries. This should be approved by the anomaly committee/Government so that Government employees who are on the receiving end after the implementation of MACP Scheme. An Government Employee who was getting the promotional scale on completion of 12 yrs shall get the promotional scale after 20 yrs of service. Because the MACP offers next higher grade not the promotional grade pay. The abolition of GP 2000 may help the lower cadres to get some relief. Hoping for favorable response.

    Dear Sir
    Please take step to rectify the anomaly persisted on implementation of MACP Scheme. After implementation of MACP Scheme an employee who was granted promotional pay scale after 12 yrs of service. Now he shall be getting the promotional grade pay on completion of 20 yrs of service.
    Sixth Pay Commission has simply created the parity between seniors and juniors. Before 31/8/08 an employee who was granted promotional pay scale on completion of 12 yrs of service are being placed in pay band PB-2 with GP of 4200. where as an employee getting MACP Scheme after 1/9/08 shall be placed in PB-1 with GP 2800 and he shall become eligible for the promotional GP of 4200 on completion of 20 yrs of service unless he is promoted and the chances of promotion before 20 yrs are very low. Because there is stagnation with no hope. The matter has been already raised by the staff side but no positive response yet.

    What happened to three pre-revised pay scale of Rs. 5000-8000,5500-9000 and 6500-10500 merged into a single pay scale of 6500-10500. The grade for these pay scale have fixed up to Rs.4200/- wef 01-01-2006 but their counter part in higher formation got the grade pay of Rs.4600/- wef 01-01-2006 to Assistant in Secretariat. Moreover, Hon’ble Delhi High Court has given its Judgement on 03 Sep 2010 for equal Pay for equal Work. Even The Hon’ble Supreme Court in UOI and others V Hiranmony Sen and others (reported in SCC(L&S) 271) has held that equal pay for equal posts can also applied if there is complete and wholesale identity between two groups (post). It was also held by the Hon’ble Supreme Court in Nehru Yuva Kendra Sangthan V Rajesh Mohan Sukhla and others (reported in SCC (L&S) 286) that equal pay for equal work will be applicable irrespectives of soruces of recruitment.

    I hope by this time DOPT Min of Fin (Deptt of Expdr) will issue necessay orders to upgradation of grade pay of 4600/- to Admin Supdt in DRDO Lab/Estt at the earliest wef 01-01-2006.

    To keep off this anomaly and to keep up the transparency and equivalence in the scale of pay, (1) different Ministries have already upgraded this scale, (2) Janmu University recruitment 2010 implemented the scale of pay Rs. 9300-34800/- with GP Rs. 4200/- for 10 open vacancies of Semi Professional Assistant along with the same qualification i,e. Graduation with BLISc, (3) Staff Selection Commission, Govt. of India designated the post as Library & Information Assistant along with the same qualification and implemented the pay scale of Rs. 9300-34800-/ with GP Rs.4200/-. (4) CSIR also recommended the pay scale of Rs. 9300-34800/- with GP Rs.4200/- for those who were in the pre-revised Rs. 4500-125-7000/-.

    So, we would request you to look into the matter and to find out positive measures to upgrade the existing scale of pay Sukumar Das & others.

    this commission does not give any +ve or -ve output it is a neutral commission of its kind.

    Employees whose increment date fell between 1 Feb to 30Jun in V th CPC time were punished without any crime and whose date of increment was 1 Dec were rewarded without doing anything. This is against the natural justice. Our representative are not doing anything. Now there should not be discussions but a legal course should be initiated by our Associations who are discussing on employee's behalf.

    Sir, I am Murali, working in Central Govt, autonomous organisation. My pay in the Month of May 2011, was 16190 +Grade Pay 4600= 20790 (in the pay band of 9300-34500)

    During June 2011, I was appointed (through advt. and selection committee) in same organisation in the pay of 15600-39100 with Grade Pay of 5400/-. I opted that that my Pay is fixed in the month of July, because I will get increment in the month of July 2011 by protecting my pay. Can any body clarify what is my pay in the month of July 2011?

    we the employee wants to remind the anamoly committee that increment post phoned by 5month from feb to july is a punishment in comparison to their counter parts who by vitue of being joined in dec05 could not get their due increment in jan'06. Efforts in this regard may please be reintiated.

    CSIR implemented sixth pay commission recommendations vide circular No. 5-1(3)/2008 PD w.e.f. 01.01.2006 accordingly Gr-III(1) and Gr-III(2) were merged to the new pay scale Rs.9300-38400 with Rs.4200 grade pay.
    New CSIR circular (circular no. 5-1(23)/2008-PD, dated 17.05.2012) mentions that on completion of combined residency period of 07 years in Gr-III(1) and Gr-III(2) post either prior to or on 21.07.2010 will be considered for assessment promotion to the next higher post of Technical Officer w.e.f. 21.07.2010.
    That means, those who have joined as Gr III (1) on 2000, 2001and 2002 , they will lose 3, 2 and 1 year respectively as 7 years of residency for them completes on 2007, 2008 and 2009 respectively.

      There are few other short comings viz
      1. It doesnot take in to account employees who have claimed earlier assessment on acquiring higher entry level qualification.
      2. If an employee joins one day befor the cut off date i.e 21.07.2010 he shall be assessed in year 2017 whereas an employee joining on 21.07.2010 shall be assessed in year 2015.

      The circular doesnot take care of the above anomalies.

    (anamoly of PBOR/mcpo NAVY) plz forward to the anamoly redressal comitte.it is important to inform u that the anamolies projested to commission is only related to commissioned officers i.e comparision with ias/ies/software engineer/buracrats etc. and they are getting one by one.but if you will seen the pay recommendation in the vi th cpc for the mcpo/subedar rank of navy they were granted grade pay rs 4600 from the previous rank pay of rs 4200.it looks good to the officers ranks for saying rs 400hike is is sufficient for mcpo rank who put off 15 years -25years to achieve the rank.but the paycommission has not noticed the actual hike is only RS 200 BECAUSE AFTER GETTING PROMOTION OF MCPO RANK NAVY CUTS AN AMOUT OF RS 240 SAYING NOT ELIGIBLE FOR GCB allowance.can u imagine this blunder in the paycommission hike in the grade pay of mcpo,which takes so many years to increse benifits of military persons.can they recommend only rs 260 for the senir rank who bears lot of responsibility.this is not good for the officer to compare and project?

    ON 1,1,06 I WAS HOLDING THE POST OF CHIEF OFFICE SUPERINTENDANT IN PERSONNEL BRANCH IN SCALE RS.7450-11500(RPS) IN THE 6TH PC THE SCLES OF RS.6500-10500 ANF RS.7450-11500 HAVE BEEN MEARGHED AND REPLACE IN 6TH PC RS.9300-34800 WITH GRADE PAY OF RS.4600/. IN ACCOUNTS DEPARTMENT THE SECTION OFFICERS HOLDING THE SCALE OF RS.7450-11500 HAVE BEEN GIVEN GRADE OF RS.4800 WHY THIS PARITY. I HAVE ALREADY PUT 40 YEARS OF SERVICE ON THIS RAILWAY AND RETIRED FROM SERVICE ON 31.5 2009. PLEASE EXAMINE OUR CASES AND DO JUSTICE IN GRANTING G.P RS.4800 W.E.F.1.1.06.

    I was joined CSIR 26.02.2003 as Technical Assistant Gr. III(1) and got promoted as Sr. Technical Assistant Gr.III(1). As per the CSIR circular (circular no. 5-1(23)/2008-PD, dated 17.05.2012). Can I eligible for Technical Officer Gr.III(3) ?

    And have one more issue I got two earlier assessment on 26.02.2011 as Technical Officer Gr. III (3) (Before the circular issued). Can I consider for Gr.III(4) promotion as earlier assessment? or else the my two year earlier assessment may lapsed.

    And have one more issue I got two earlier assessment on 26.02.2011 as Technical Officer Gr. III (3) (Before the circular issued). Can I consider for Gr.III(4) promotion as earlier assessment? or else the my two year earlier assessment may lapsed.

    dear sir i m facing great anamaly in my pay fixation.i was drawing more payment as compare to my senior and junior batch before pay imlimentation and after implimantation in oct 08 my pay hike become much less as compare to senior and junior batch.on jan 06 my basic was 5400 and its increment date was mar 06 how ever i got promotion to basic pay 6000 in feb 06 in pre-revised scale.so after pay fixation my pay was fixed from feb 06 i.e 1.86×6000 with grade pay 4200 but no increment in jul 06 due to non complition of 6months ,hence my basic pay lag behind to my friends for (rs 800less) who got promotion in 31st dec 05 to basic pay 6000 as they got increment in jul 06.again when the redressal committe told people will get one increment for those who has increment due from 2nd jan to 30 jun 06 in pre-revised amount.but i was not givet that increment to my basic amount 5400 as i got promotion to rs 6000 basic pay just one month before increment month.and my juniors who got promotion to rs 6000 basic pay in may 06 got increment for their previous rank as it was falling in mar 06.it is clear i was given any annual increament from mar 2005 to jul 2007 how ever rest all people got three increments in this periob i.e one in jul 06 in revised scale,one in pre revised scale in jan 06 and one in jul 07 causing less arrears and basic pay for me as compare to others.pls give some suggestion to come out of the hardship.

    Hearty Congratulaions and Thanks to the Honourable NAC members in doing justice though late ,to those unfortunate employees whose DNI falls between Feb 2006-June 2006 by granting one increment in the pre-revised scale on 1st Jan 2006 and granting them one increment in Revised Scale on 1st July 2006 ,as a one time gesture.
    Inorder to avoid the desparity ,it is only a similar and fair justice to grant one increment in the revised scale on 1st July 2006 to those employees who opt for their Pay revision on their date of Promotion between Feb 2006-June 2006 ,as a one time gesture.
    I request the immediate attention of the Honourable NAC members for favourable consideration ,towards issue of the necessary Office Orders .
    Otherwise people some people will enjoy by availing 2-3 annual increments within a span of 1 year ,some unfortunate employees will suffer due not gettint any annual increments for 2years due to the unnoticed big anamoly as I have explained below:-

However rest all people got 3-4 increments in this period i.e one in jul 06 in revised scale,one in pre revised scale in jan 06 and one in jul 07 causing less arrears and basic pay for me as compare to others.     Sir, I am Administrative Officer Gr II, working in MOD(Navy), I have been recruited in Navy through UPSC as Admin Officer Gr II,a Group B gazetted post in pre revised pay scale 6500-10500.As per DOPT Om 1/1/2008/IC dated 13 Nov 2009 posts that exists in the pre revised pay scale of 6500-10500 before 01-01-2006 iincluding that of field offices has been upgraded to 7450-11500 wef1-1-2006. Accordingly, the AO-II have also been granted grade pay of Rs 4600 as in case of office staff of the Secretariat. The secretariat office staff has further allowed Grade Pay 5400 on completion of 4 years but the same not extended to Admin Officer Grade II in Navy.
    I have already completed 12 Years but no promotion due to faulty revision of RR in 2005 and other hand no redrasal to this anomaly.
    Kindly look in to the matter and advise.I will submit detail case if desired.

    Hello, I was appointed as store keeper in Fire and Emergency Services, Daman in the pay scale of PB1 (52000-20200 GP:1900) and found later that other union territories are paying grade pay of Rs. 2400/- . The proposal was put up with the Ministry with regard to anomalies in pay scales of Fire Personnels, Daman and Diu. It is regretted to state that we have not received any progress so far. What concentrete steps shall we take to fix anamolies in pay… please help…
